New Planning Application for Country Choice

Apparently there is another planning application for change of use for Country Choice. On the face of it it looks subtly different to the last one (and it’s appeal) in that it is looking to change use to a Cafe during the day and a Hot Food Takeaway during the evening. Details are here. The public consultation is open until June 6th. You can give your opinion by filling out the form at the bottom of the page linked to above.

If you haven’t got the time to go through the previous applications here is a potted summary:

First application, NP/DDD/1112/1194, validated 3rd January, decision 23rd March 2013 was refused on:

  • Insufficient evidence to demonstrate that the existing A1 shop use is not viable or that other alternative community needs could be accommodated within the building.
  • Would contribute to a loss of vitality and viability of the community and adversely impact upon the established character of the village.

Second application NP/DDD/0513/0429, validated 19th June, decision 14th September 2013 was refused on:

  • Insufficient evidence to demonstrate that the existing A1 shop use is not viable or that other alternative community needs could be accommodated within the building.
  • Unsuitable for a building located in a residential area and would result in an unacceptable level of noise and disturbance to adjacent residential properties from the additional roadside parking generated by the proposed take-away the foodshop use.

It was the Peak Park members who overturned an officers decision to recommend it.

Appeal APP/M9496/A/13/2209487, decision 3rd March 2014 was refused on:

  • Change of use would cause significant harm to the living conditions of nearby residents and would, therefore, be contrary to policies HC5 C and GSP3 E-F of the CS that seek to protect the living conditions of local communities and guard against an inappropriate forms of use.
  • Given the harm that would be caused to local residents, I conclude that this development would not be sustainable and that would therefore be contrary to paragraph 9 of the National Planning Policy Framework
